Debtworks takes the privacy of its clients and debtors seriously. Debtworks acknowledge the responsibility it has to protect and manage your data safely. Our Privacy Statement outlines how we use, collect and store personal information.

The relevant governing legislation in New Zealand is the Privacy Act 1993 (“the Act”). Under the Act, there are a number of guiding principles for businesses to follow when dealing with personal data. Debtworks have embedded these principles within our Privacy Statement and apply them to all dealings with personal information.

“Debtworks”, “we”, “us” and “our” refers to Debtworks (NZ) Limited, any subsidiary, parent or associated company, and any entity carrying on business in New Zealand that comprises part of the Debtworks group of entities.

“Personal information”, “information”, “personal data” and “data” means any identifiable information about an individual, such as a name, address, or phone number.

COLLECTION OF PERSONAL INFORMATION

There are three ways in which we generally collect personal information in relation to our business:

From third parties: clients will provide us with information on their debtors in order for us to contact debtors and advise them of their debt. Our clients make their best efforts to ensure this data is accurate and up to date. We also may collect information about you from publicly available sources and databases.

From you directly: we collect information that you provide to us, such as your current contact information.

Automatically: when you visit us online, exchange emails with us, or call our offices, our systems may automatically collect some information from you, such as your caller ID, IP address, and cookies.

We may use your personal information for the following purposes:

Contacting you: We may contact you to advise you if you have a debt, communicate with you, respond to any queries you may have, advise you of any key updates on your account, provide you with information you have requested, or request information from you. We may also contact you in regards to dispute resolution, fraud accounts, or legal action in relation to a debt

Analysis and Reporting: We analyse trends and statistics to provide insights into the industry. We may aggregate and anonymise your data to provide statistical information for our team, our agents and our clients.

System Services: Monitoring how our website and interfaces are used provides us with information on how to streamline and improve our portals, meaning a better user experience for you in the future.

Protecting ourselves: In the event that it becomes necessary to protect or enforce our legal rights.

At times, we may need to share your personal information. Some of the most common situations are:

Within Debtworks: we may share your information within the Debworks company and across teams and personnel. Our usual data protection policies apply in order to ensure the confidentiality and security of your data within our company/companies.

With our third party suppliers, agents and partners: We work with a number of third parties who may require your personal information in order to carry out services we have requested of them (for example Credit Reporting Bureaus).

Regulatory or law enforcement bodies or Government agencies: We may provide information in cases where it is required to assist in compliance with the law.

We may also share your information in situations where we consider it necessary to assist in protection of the public revenue, or prevent or lessen a threat to public health and safety.

Ensuring your data is safe is a priority of ours, and we have a series of controls and measures throughout our organisation and in all of the technologies we use to protect data and prevent breaches or data theft.

Personal information is stored on our secure servers, which are monitored 24/7 by a third party specialist security company. We operate a paperless office and our physical sites and equipment are secured by a series of controls.

You have the right to know what information we hold on you and upon request, receive a copy of all personal data we hold on you. You may also request corrections to your personal data.
